Terms of Service

1) Not Medical Advice

MyCoachBob provides fitness, wellness, and educational information only. The Services do not provide medical advice and are not intended to diagnose, treat, cure, or prevent any disease.

Always consult a qualified healthcare professional before beginning a new exercise program, especially if you have a medical condition, injury, are pregnant, or experience pain or discomfort.

You assume all risks associated with exercise and use of the Services.

2) Eligibility

The Services are intended for users 16 years of age or older. By using the Services, you confirm you meet this requirement.

3) Account Registration and Security

You may need to create an account to use certain features. You agree to:

• Provide accurate and current information
• Maintain the security of your account credentials
• Notify us promptly of any unauthorized access or security breach

You are responsible for all activity that occurs under your account.

4) Subscriptions, Free Trials, Billing, and Renewals (iOS)

Some features require a paid subscription ("Subscription"). Subscription options and pricing are shown in the App at the time of purchase.

4.1 Apple In-App Purchase

If you purchase a Subscription in the App:

• Payment will be charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your Subscription in your Apple ID subscription settings.

4.2 Free Trials and Introductory Offers

If a free trial or introductory offer is available, it begins when you confirm your purchase. Unless you cancel at least 24 hours before the trial ends, you will be charged the subscription price shown in the App and your Subscription will auto-renew.

4.3 Changes and Availability

Subscription offerings, pricing, and availability may change as permitted by Apple's policies and applicable law.

5) Refunds

Refunds for iOS in-app purchases are handled by Apple and are subject to Apple's refund policies and processes. We do not control Apple's decisions regarding refunds.

6) Your Content and Permissions

The Services may allow you to submit content, including workout information, logs, messages, and videos submitted for form analysis ("User Content").

You retain ownership of your User Content. However, you grant MyCoachBob a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your User Content solely to operate, provide, maintain, and improve the Services, including:

• Generating personalized workout plans
• Providing coaching responses
• Analyzing videos for form feedback
• Providing customer support and troubleshooting

7) Form Check Videos

If you use the Form Check feature:

• Videos are uploaded and stored in our backend storage (currently Supabase Storage) to provide feedback and maintain your history.
• Videos remain stored until you delete them (if available) or until your account is deleted in accordance with Section 11 (Account Deletion).

8) Acceptable Use

You agree not to:

• Use the Services for unlawful purposes
• Attempt to access or probe systems or accounts you are not authorized to access
• Reverse engineer, decompile, or attempt to extract source code (except to the extent allowed by law)
• Upload malicious code or interfere with the Services
• Submit content you don't have the right to submit
• Use the Services in a way that could harm others or MyCoachBob

We may suspend or terminate access for violations.

9) AI-Enabled Features and Third-Party Processors

Some features (such as coaching and program generation) may use automated systems and/or third-party AI providers (e.g., large language model providers). Providers may change over time.

You understand and agree that:

• Outputs are generated based on the information you provide and may be imperfect.
• You are responsible for applying judgment and exercising caution, especially around training intensity, injury risk, and any medical conditions.

10) Intellectual Property

The Services, including all software, design, text, graphics, and trademarks (excluding your User Content), are owned by MyCoachBob or its licensors and are protected by intellectual property laws.

We grant you a limited, personal, non-transferable, revocable license to use the Services for your own personal, non-commercial use, subject to these Terms.

11) Account Deletion and Grace Period

You can initiate account deletion in the App.

When you request deletion:

• Your account is scheduled for deletion after a 30-day grace period.
• During the grace period, you may have the option to restore your account (if supported in-app).
• After the grace period, we delete your account and associated data, including stored videos, except where limited retention is required for legal, security, or backup purposes.

12) Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee the Services will be uninterrupted, secure, or error-free.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYCOACHBOB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYCOACHBOB'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $50 IF YOU PAID NOTHING).

Some jurisdictions do not allow certain limitations; in that case, limitations apply to the maximum extent permitted.

14) Changes to the Services or Terms

We may update the Services and these Terms. If changes are material, we will provide notice as appropriate (for example, via in-app notice). Continued use of the Services after changes means you accept the updated Terms.

15) Governing Law

These Terms are governed by the laws of Québec, Canada, without regard to conflict of laws principles, except where mandatory consumer protection laws apply.
